Privacy Policy Roth Information Assistant - RIA (abridged version)
The software application offered (hereinafter only: "App") is a service app that is intended to make it easier for installers and their employees to work with our products on the construction site, but also to plan projects in the panel heating and cooling sector. This privacy policy follows the "layered approach". You will receive a transparent and summarized data protection declaration, which contains the essential points. For detailed information on the data processed in connection with this app, we would like to refer you to the long version of the privacy policy, which you can view further down on this page.
The data collected by the app is processed primarily for the purpose of providing you with the app and its functionalities. The legal basis according to Art. 6 para. 1 lit. b) DSGVO is the user relationship that you establish by registering an account. Furthermore, we use collected inventory and communication data to evaluate and improve our services. This enables us to continuously improve our support in the event of difficulties with our products and to provide you with a continuously improved user experience. The legal basis in this respect is our legitimate interest pursuant to Art. 6 (1) f) DSGVO. In principle, we store your data as long as your account exists for the purpose of processing the user relationship. Beyond that, we only store your data as long as we have a legitimate interest in evaluating it. Subsequently, we delete your data, unless the further processing of the data is necessary for the exercise of the right to freedom of expression and information, for the fulfillment of a legal obligation, for reasons of public interest or for the assertion, exercise or defense of legal claims. You are entitled to object to the further processing of your data, the processing of which we carry out on the basis of a legitimate interest. To do so, send an e-mail with your justified objection to: ria@roth-werke.de. In order to successfully assert the objection, it is necessary that there are reasons for your objection that arise from your particular situation. We will then delete the corresponding data immediately, unless one of the aforementioned reasons entitles or obligates us to further processing. In addition, you can request information about your data stored by us and have incorrect data corrected or your processing restricted. You can also complain to a supervisory authority or request the porting of your data.

2 Collection and storage of personal data as well as type and purpose of their use
a) When using the app without account registration
In principle, you can use our app without registering with an account. In this case, not all functions of the app are available to you. You can use the "Product Info" function to access technical product data and installation videos for our products. You can use the "System finder" " function to check which products or systems are suitable for which structural conditions. In connection with the System Finder function, you can use an EAN scanner via your cell phone. For this, you must grant the app certain access rights to your smartphone. If you use our app without registering with an account, certain information is automatically sent by your end device to the server on which the app is operated. We store the following information for seven days. This happens automatically. The following information is collected and stored until automated deletion:

  • IP address of the end device
  • Time of interaction or retrieval of information.

We process the aforementioned data for the following purposes:
 

  • Ensuring the usability of our app
  • evaluation of system security and stability, and
  • for other administrative purposes.

The legal basis for the data processing is Art. 6 para. 1 p. 1 lit. f DSGVO. Our legitimate interest in the aforementioned data processing results from the previously listed purposes for data collection. We do not use the collected data to draw conclusions about your person.
b) When using the user area.
If you would like to use the other functions of our app, we offer you a closed user area. To use the user area, it is necessary to register an account. The registration of your account takes place via a registration form. It is necessary to enter your name, e-mail address, company and address so that we can create an account for you and know which user the account is assigned to. Further information can be provided voluntarily.
The data processing for the purpose of using the user area is carried out in accordance with Art. 6 para. 1 p. 1 lit. b DSGVO.
If you wish to delete your account, please send your deletion request to the following e-mail address: ria@roth-werke.de. We will then follow up your deletion request in a timely manner, unless further processing of the data is necessary to exercise the right to freedom of expression and information, to comply with a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims.
If you have questions about our products, the app offers you the optional option of contacting the sales representative responsible for you directly. To use this function, it is necessary that you provide your postal code and a telephone number where we can reach you as part of the registration of your account, so that we can determine your responsible field service representative via your postal code and they can contact you by telephone.
Data processing for the purpose of contacting our sales representatives is carried out in accordance with Art. 6 (1) p. 1 lit. f DSGVO on the basis of our legitimate interest, as we assume that you consent to the processing of your data within the scope of the optional function if you voluntarily enter the aforementioned information in the knowledge of the purposes of use, which are evident from this data protection declaration.
bb) Usage data
You use our app on your own responsibility. Supplementary information on this is available in our Terms of Use, which you can view at www.roth-werke.de/de/roth-nutzungsbedingung-fuer-app.htm. You generate usage data when using our app either by communicating with our customer service via chat (hereinafter "chat histories") or by using the project management and project documentation functions. Within the scope of the Project Management and Project Documentation functions, you can save and manage the projects that you (e.g., as a craftsman) are in charge of. For this purpose, you can save various project-related information. It is not necessary to enter personal data to manage your projects. Nevertheless, you can store information about the client, the contractor and the address of a specific construction project. You can then use the information you have entered to create inspection reports and warranty certificates for our products directly via the app and make them available to your customers via a share function.
If you, as a registered user, communicate, upload or enter personal data of yourself or third parties through chat histories or the functions of the app (such as project management and project documentation) and do not act exclusively in the exercise of personal or family activities, this may constitute a data processing operation that falls within the scope of the GDPR. As a result, you as an individual user are the "controller" of the data processing pursuant to Art. 4 No. 7 DSGVO. We ultimately have no influence on whether you enter personal data when using our app or communicate personal data in chats. We therefore assume that you are the controller for these data processing operations if the aforementioned requirements are met. If, contrary to our legal opinion, a joint responsibility is nevertheless established between you and us with regard to your usage data, you assume primary responsibility for these data processing operations in accordance with our Terms of Use (www.roth-werke.de/de/roth-nutzungsbedingung-fuer-app.htm). In all other respects, the following information applies.

We provide our users with the technical framework for using the app. In doing so, we store the projects managed by our users as well as the chat histories of our users with our customer service in order to offer our services to our users, to enable secure communication of our users and to continuously improve our customer service. We generally do not view, review or evaluate our users' communications. The legal basis of this data processing carried out by us is Art. 6 para. 1 p. 1 lit. b DSGVO, insofar as the storage is necessary for the implementation of the user relationship and otherwise Art. 6 para. 1 p. 1 lit. f DSGVO. Our legitimate interest then results from the purpose of the data processing, because without a storage of the aforementioned data we cannot offer you our services.
If you wish to delete your account and send us a corresponding request, we will generally also delete the usage data generated by you. Your chat history with other users can still be viewed by the users involved in the chat. However, we will delete your name so that you will no longer be listed under your name in the chat history of the user involved, but as a "deleted user".
There is an exception to the aforementioned principles if we continue to process the usage data because this is necessary for reasons of public interest or for the assertion, exercise or defense of legal claims, or to enable criminal prosecution (bullying, abuse). This requires that we have been informed of the underlying facts in good time before deleting the data, as we do not generally view, review or evaluate the communications of our users.
In this case, the legal basis for the data processing is also Art. 6 para. 1 p. 1 lit. f DSGVO. Our legitimate interest in the aforementioned data processing then results from the purposes listed above.

3. commissioned processing
For hosting the technical infrastructure of our app, we use the services of bytepark GmbH, Schützenstr. 8, 10117 Berlin, with whom we have concluded an order processing agreement that complies with the legal requirements.

4. transfer of data
We do not transfer your personal data to third parties for purposes other than those listed below.
We only pass on your personal data to third parties if:

  • you have given your express consent to this in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO,
  • the disclosure is necessary for the assertion, exercise or defense of legal claims pursuant to Art. 6 para. 1 p. 1 lit. f DSGVO and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,
  • if we are legally obliged to disclose your data according to Art. 6 para. 1 p. 1 lit. c DSGVO, as well as
  • this is legally permissible and necessary according to Art. 6 para. 1 p. 1 lit. b DSGVO for the processing of contractual relationships with you.

 

5. data subject rights
You have the right

In accordance with Art. 15 DSGVO, to request information about your personal data processed by us. In particular, you can request information about the purposes of the processing, the categories of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information about its details;
pursuant to Art. 16 DSGVO, to request the correction of incorrect or incomplete personal data stored by us without undue delay;
pursuant to Art. 17 DSGVO, to request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims;
in accordance with Art. 18 DSGVO, to request the restriction of the processing of your personal data if
- you dispute the accuracy of the personal data and it was possible for us to verify the accuracy of the data, or
- the processing is unlawful and you object to the erasure of the personal data and request instead the restriction of the use of the personal data, or
- we no longer need the data for the purposes of processing and you, on the other hand, require the data for the assertion, exercise or defense of legal claims, or
- you have objected to the processing as long as it has not yet been determined whether the legitimate grounds on our part or yours prevail.
pursuant to Art. 20 DSGVO to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request the transfer to another controller;
in accordance with Art. 7 (3) DSGVO, to revoke your consent once given to us at any time. This has the consequence that we may no longer continue the data processing, which was based on this consent, for the future; and
complain to a supervisory authority in accordance with Art. 77 DSGVO. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters for this purpose.


6. right of objection
If we process your personal data based on our legitimate interests pursuant to Art. 6 (1) p. 1 lit. f DSGVO, you have the right to object to the specific processing of the personal data pursuant to Art. 21 DSGVO. Insofar as your objection is directed against direct marketing, you have a general right of objection, which will also be implemented by us without specifying a particular situation. Otherwise, in order to successfully assert the objection, it is necessary that there are reasons for your objection that arise from your particular situation.

7. data security
The data transfer between the app and our servers takes place exclusively via encrypted TLS connections (so-called transport encryption).
Access to account data and a login to the closed area of the app requires the entry of a password, which you define yourself during registration. This password must have a minimum length of 8 characters.
To protect your data against accidental or intentional manipulation, partial or complete loss, destruction, or against unauthorized access by third parties, we also use appropriate technical and organizational security measures (TOMs). We continuously revise and improve our security measures in line with technological developments.

This data protection declaration is as of 26.02.2019 and is currently valid.
Changing legal or regulatory requirements, developments in case law and further developments to our app or our products and services may make changes to our privacy policy necessary.
